What are the steps?
Depending on the facts and circumstances of your matter, our lawyer will advise you on what to expect in a divorce proceeding. Generally but not always, the following will ensue if you are ready to proceed with mutual divorce: -

Appointment and discussion Upon confirmation of our appointment, we will discuss your matter with you in detail. Once the divorce terms have been agreed, we will prepare the documents and process all the paperwork prior to your signing of documents. |

Signing of documents After the documents are prepared, usually within a few working days after confirmation of divorce terms, we will make an appointment with you for the signing of documents. All the terms will be explained to you before signing. |

Court hearing Upon signing of the documents, we will file the same to the court. The court will process the documents and a hearing date will be fixed. Depending on the schedule of the court, the matter may be fixed for hearing within a few weeks after filing. |

Update of JPN status After hearing by the court, we will process the remaining paperwork, which will involve the filing of the court orders and extraction of the same. Thereafter, we will submit the court documents to JPN for update of your marital status. |

- NRIC of both parties (husband & wife of the marriage) - latest passport if non-Malaysian
- your marriage certificate
- birth certificates of all children of the marriage
- documents relating to the properties (copy of SPA or land title)
- any other documents which we will advise from time to time

What if you have already obtained a divorce outside of Malaysia?
Alternatively, if you have obtained a divorce order in that foreign country, we can assist you to get that overseas divorce order recognised and registered in Malaysia as well as to update your JPN marital status / marriage record.
After obtaining the divorce order in the foreign country, it does not mean that the JPN will recognise the said divorce order. The JPN does not have the authority to register the divorce order obtained from the courts of a foreign country. In this case, you will have to apply to the High Court of Malaya under Section 107 (3) of the Law Reform (Marriage and Divorce) Act 1976 (Act 164) for an order to recognise the foreign divorce order, as well as to provide the JPN with the relevant authority to recognise and to register the foreign divorce order.
Our lawyers regularly advise and represent clients in the High Court of Malaya in family and divorce matters, including any application to the High Court under Section 107 (3) of Act 164 for the recognition of the divorce order obtained from a foreign country (overseas / outside of Malaysia).
